New Texas Legislation: “Loser Pays” June 6th, 2011Recent Legal News New Texas legislation hopes to protect businesses from frivolous cases by implementing a “loser pays” tort reform. Law makers hope the legislation will encourage litigants to “consider the practicality of their complaint before taking legal action…and protect defendants from the dire financial impact of frivolous cases.” Under the new rule, litigants will be responsible for paying the attorney fees of the defendant if the case is determined groundless.
